This appeal is from an order of the trial court which sustained demurrers which the defendant made to the complaint and amended
complaint. Both complaints assert liability of the defendant on the theories of nuisance and violation of the safe-place statute.
The plaintiff, Clair Niedfelt, sues to recover damages for his personal injuries. The plaintiff, Rosa Tally, is Clair's mother,
and she sues for medical and hospital expenses and also for the loss of services of her son. The defendant, Joint School District No. 1, operates certain public schools, including the Viroqua public high school. The
defendant School District carries a comprehensive liability insurance policy, and such policy provides that the insurer will
pay on behalf of the insured all sums which the insured shall become "legally obligated" to pay as damages because of bodily
injury, sustained by any person and caused by accident.
