At approximately 2:20 p. m. on February 8, 1964, the defendant, Alfred Wold, was proceeding in a northerly direction along South Delaware avenue in the city of Milwaukee. At midblock, between East Pryor and East Iron streets, he collided with the plaintiff, Thomas Nieman, who at the time was only six years of age. Thomas and a pal, Timothy Hirthe, had been on the east side of Delaware avenue rolling (or throwing) rocks toward some other boys who were across the street. Thomas interrupted this activity and stepped off the curb, starting to cross the street between two cars. While crossing the street he was struck by the front of the Wold automobile.
